Step 7 of 8 · Offer and sale agreement

Purchase offer and sale agreement: what are you committing to?

In Belgium, the sale is concluded as soon as the seller and the buyer agree on the property and the price: an accepted written offer commits you. The sale agreement (compromis) then puts this agreement in writing, with its conditions, and the buyer pays a deposit.

Before accepting an offer, we check with you the price, the conditions (for example obtaining a mortgage) and the proposed timing. A lower offer without conditions can be worth more than a higher, fragile one.

The sale agreement specifies:

  • the price and the deposit, generally 10% paid on signing the sale agreement (sometimes 5%, for example for a new build);
  • the conditions precedent, such as obtaining the mortgage;
  • the date for signing the authentic deed, generally within four months;
  • the documents handed to the buyer.

The sale agreement is drawn up at the agency or by the notary, depending on the file.
